PLEASE READ THE FOLLOWING TERMS AND CONDITIONS WHICH PROVIDE IMPORTANT INFORMATION ABOUT HIRING WITH US
These Terms and Conditions form part of the rental contract stipulated between n+1 Bicycles (CIF: Y2783646Q) and the hirer.
1) CANCELLATION POLICY
If you want to cancel your bike reservation our policy is as follow:
up to 4 weeks before 1st. rental day: full refund of the paid amount;
4 to 2 weeks before 1st. rental day: 50% refund of the paid amount;
2 to 1 week before 1st. rental day: 20% refund of the paid amount;
within 7 days before 1st. rental day, no refund will be given.
2) PAYMENT
Payment must be done when you make the reservation. We accept major credit cards like VISA, MasterCard. You can also pay by making a bank transfer to our Spanish bank account.
3) COLLECTION/HANDING OVER AND RETURN OF THE BIKE
All bikes rented from n+1 Bicycles will only be delivered to/handed over to the person named on the rental contract, upon production of an identification document (passport or European ID card).
By signing the rental contract that comes with the bike, the hirer confirms that the bike was delivered/collected in perfect technical, safe and clean condition, and unterkates to return it in the same condition as it was delivered/collected.
The hirer is responsible for taking proper and reasonable care of the bike during the hire period, and will return it/have it collected in good order and condition to n+1 Bicycles by 18:00 on the return date specified in the contract, unless otherwise agreed by the parties. It is essential that the hirer notifies n+1 Bicycles of any issues preventing a timely return of the rented bike. Lacking such notification, late returns will be charged EUR 110 + EUR 50 per day until the bike is safely returned to n+1 Bicycles. After 3 days from the agreed return date, any unreturned rented bike will be charged at its full replacement cost and will be reported as stolen to the police.
4) LIABILITY IN CASE OF DAMAGE, LOSS OR ACCIDENT
Cycling may involve risks. By signing the rental contract, the hirer accepts sole responsibility for the bike and the safety of the hirer and others.
n+1 Bicycles may not be held responsible or liable for any personal injury suffered by the hirer whilst riding the bike during the hire period.
It is fully understood that it is the hirer’s responsibility to acquire adequate personal insurance to cover any eventuality that may occur, including theft, damage and accidents caused by the hirer or any third party or their properties during the hire period. It is highly recommended to carry your insurance documentation and identification with you at all times whilst riding the bike.
The hirer must notify n+1 Bicycles immediately if the bike is damaged or lost and follow any instructions provided by n+1 Bicycles in relation to such eventualities. In case of theft, the hirer must report the event to the nearest police station and notify n+1 Bicycles.
Except for reasonable wear and tear and damage to inner tubes, in case of any damage to the bike however caused, that is not covered by the optional insurance, the hirer will be responsible for and will pay n+1 Bicycles the full cost of all repairs, including the cost of replacing any damaged parts and any labour to restore the bike to the condition it was in at the beginning of the hire period. n+1 Bicycles has the sole right to reasonably determine: (a) whether the bike was damaged during the hire period; (b) whether such damage is beyond reasonable wear and tear; (c) the extent of such damage; and (d) the full cost of the repairs required.
In the case of loss of the bike, however caused (including theft), the hirer will be responsible for and will pay n+1 Bicycles the full cost sustained by n+1 Bicycles to replace the lost bike.
In addition to the above, the hirer will be responsible for and will indemnify n+1 Bicycles for any loss of revenue suffered by n+1 Bicycles due to the unavailability of the bike for hire resulting from damage or loss. The costs for lost revenue will not exceed the equivalent of 7 days hire of the bike at the full prevailing hire rates.
For the purposes stated under section 3) Liability in Case of Damage, Loss or Accident of these Terms and Conditions, the hirer authorizes n+1 Bicycles to recover such repair or replacement costs and/or loss of revenue by charging the relevant amounts to the credit card provided by the hirer unpon signing the rental contract.
5) RENTED ITEMS AND INSURANCE
Bikes and equipment hired on the rental agreement remain the property of n+1 Bicycles. The hirer is obliged to take good care of all equipment hired and take all precautions necessary to avoid damage, loss and theft. The optional insurance does not cover loss or theft, frame damage or damage caused by reckless handling or improper use of the bike, including, but not limited to, use off-road.
n+1 Bicycles does NOT provide helmets, GPS, etc. Please make sure you bring your own accessories and equipment to ride safely.
It is NOT allowed to take the rented bike out of Mallorca, to mainland Spain or other islands.
When the bike is returned at the end of the rental period n+1 Bicycles will examine it to check if any damage occurred.
Upon signing the rental agreement, the hirer accepts that the full replacement cost of any uninsured damage found to the bike after return/pickup will be charged to the provided credit card; the hirer will be informed by e-mail of the details of the damage and amount charged.
Important: DO NOT leave the bike unattended at any time. The hirer will be responsible for the full replacement cost of the bicycle, at the current market price, if it is lost or stolen during the period of hire. The hirer will incur penalties and extra costs for late return of the bike. Please see section 3) above.
6) DELIVERY SERVICE
n+1 Bicycles will deliver and pick up the rented bike to the hirer at the location specified in the rental contract free of charge. Delivery and pick up times will need to be agreed with n+1 Bicycles. The hirer can also agree with n+1 Bicycles a convenient time to collect and/or drop off the bike at n+1 Bicycles’s address in Pollença. Please make sure the time of collection and/or drop off has been confirmed.
7) TRAFFIC LAWS
The hirer is fully responsible for abiding by all traffic laws and regulations existing in Spain, including wearing a helmet at all times whilst riding a bike in Mallorca.
8) N+1 BICYCLES’ LIABILITY AND INDEMNITY
The hirer agrees that n+1 Bicycles will not be liable to the hirer for: (a) any injury or loss suffered by the hirer or others; or (b) any damage to any property of n+1 Bicycles or others arising directly or indirectly from the use of the rented bike, irrespective of how such injury, loss or damage occurs.
Subject to such exclusion of liability, the maximum liability of n+1 Bicycles for all claims made by the hirer, whether as a result of any breach of these Terms and Conditions or on any other ground or terms whatsoever (including, but not limited to, liability derived from tort and/or negligence) will not exceed the total price paid by the hirer to n+1 Bicycles.
No provision, other than those which are mandatory, will be implied by statute or common law or otherwise into the contract against n+1 Bicycles. No representations, express or implied conditions or warranties will be binding upon n+1 Bicycles unless stated in writing.
The hirer agrees to indemnify n+1 Bicycles against all claims, damages or losses (including costs), which n+1 Bicycles incurs as the direct or indirect result of the bike use by the hirer or by any other party.
If our service becomes unavailable due to circumstances that are beyond n+1 Bicycles’ control (such as damage from an earlier hirer), n+1 Bicycles will try to offer the hirer a suitable alternative or provide a full refund.
9) COPYRIGHT
All content published in this website, including texts, photographs, logos and the likes, is to be considered as intellectual property of n+1 Bicycles. Any unauthorized use, distribution and/or reproduction of such content is therefore prohibited. All mentioned trade names and brand names are the property of the respective legal owners.
10) APPLICABLE LAW
The hirer agrees that the laws/jurisdiction of Spain apply to these Terms and Conditions and rental contract. The hirer warrants to have fully read and understood these Terms and Conditions before entering into the Contract.
If any part of these Terms and Conditions or its application to any party or any circumstances is or becomes unenforceable, void or illegal, unless that part is essential to the operation of the contract or in conflict with public policy, the remaining terms and conditions will not be affected and will maintain full force and effect.

Any translated content of the website, including these Terms and Conditions, is provided esclusively for the convenience of the website visitors and bike hirers. Should there be any inconsistencies between the English version and the translated versions, the English version will prevail for all purposes.
